Time Limits For Making A Medical Negligence Insurance Claim

Anyone making a medical negligence claim will need to start the claim within three years of finding out there is an issue. The reason for this is because the person making the claim may not realise straight away, they may notice only after the illness or injury gets worse. There are a few exceptions, however:  

Mental Capacity – There is no time limit for making a claim if the person lacks the capacity to make the medical negligence claim themselves. 

Children – Medical Negligence Insurance involving a child can be made any time before the child turns 18. Once the child turns 18 the three-year rule will start, meaning the claim will need to be made before they turn 21.
